Terms of Service

PromptDek is an AI prompt marketplace and image generation platform. The Service allows users to:

• Browse and purchase curated AI image prompt templates organized into packs and individual prompts.
• Generate AI images using purchased prompts powered by OpenAI's GPT Image 2 model.
• Store and manage a personal library of generated images.
• Subscribe to plans that provide ongoing access to the full prompt library and monthly generation credits.

The Service is provided “as is” and subject to change. We reserve the right to modify, suspend, or discontinue any feature at any time with or without notice.

• You must be at least 13 years old to use the Service. By using PromptDek, you represent that you meet this requirement.
• You must create an account to purchase prompts or generate images. Accounts are created via Google OAuth.
• You are responsible for maintaining the confidentiality of your account and for all activity that occurs under your account.
• You may not share your account with others or create multiple accounts to circumvent restrictions or access controls.
• We reserve the right to terminate accounts that violate these Terms.

PromptDek offers two purchasing models:

Individual Prompts and Packs

• Individual prompts and prompt packs are available for one-time purchase at listed prices.
• Once purchased, you retain access to that prompt content indefinitely, subject to your account remaining in good standing.

Subscriptions

• Subscription plans provide access to the full prompt library plus a monthly allocation of image generation credits.
• Subscriptions are billed on a recurring monthly basis. You may cancel at any time from your account settings.
• Canceling a subscription ends access at the conclusion of the current billing period. Credits and library access are not prorated.

Generation Credits

• Generation credits are consumed when you use the AI image generation feature. Credits are non-transferable and have no cash value.
• Credits included in a subscription plan expire at the end of each billing cycle and do not roll over.
• Additional credits may be purchased separately.
• Prompt pack purchases include bonus generation credits at a rate of 3 credits per prompt in the pack.

All prices are listed in US dollars. Payment is processed by Stripe. By completing a purchase, you authorize us to charge the listed amount to your selected payment method.

All sales are final. Because our products are digital goods that are immediately accessible upon purchase, we generally do not offer refunds. This includes:

• Individual prompt and pack purchases.
• Subscription fees for the current or past billing periods.
• Generation credits, whether purchased or included in a subscription.

Exceptions may be made at our sole discretion in cases of duplicate charges, technical errors on our end that prevented access to purchased content, or unauthorized transactions. To request a refund exception, contact promptdek@gmail.com within 7 days of the purchase date with your order details.

You agree not to use PromptDek to:

• Generate images that are illegal, obscene, defamatory, or that violate the rights of any third party.
• Generate content depicting minors in any sexual or exploitative manner.
• Generate images intended to deceive, defraud, or harass any person.
• Attempt to reverse-engineer, scrape, or extract prompt content in bulk through automated means.
• Resell, sublicense, or redistribute the prompt templates themselves as your own product or service.
• Circumvent any access controls or payment systems.
• Violate OpenAI's usage policies, which govern the underlying image generation model.

We reserve the right to terminate accounts and revoke access without refund for violations of this section.

Prompt Templates

All prompt templates, pack names, descriptions, and related content on PromptDek are the intellectual property of PromptDek or our licensors. Purchase of a prompt grants you a personal, non-exclusive, non-transferable license to use that prompt for your own image generation. You may not resell, sublicense, or distribute prompt text to third parties.

Generated Images

Images you generate using our Service using your purchased prompts and credits are owned by you, subject to any restrictions imposed by OpenAI's terms of service for content created with their models. You may use, publish, and commercialize your generated images for personal and commercial projects.

You may not represent AI-generated images as original photographs for deceptive purposes, submit them to stock photo platforms without appropriate AI-generated content disclosure, or use them in ways that violate applicable law.

Your Content

By uploading reference images for image-to-image generation, you represent that you have the right to use and submit that content. You grant us a limited license to process and transmit the image to OpenAI solely for the purpose of generating your requested output.

PromptDek uses OpenAI's GPT Image 2 model for image generation. We make no warranties regarding the accuracy, quality, appropriateness, or fitness for any particular purpose of AI-generated images. Results may vary based on the prompt, reference image, model version, and other factors outside our control.

AI-generated images may occasionally produce unexpected, inaccurate, or unintended content. You are responsible for reviewing generated images before any use. We are not liable for any harm arising from the use of AI-generated content.

To the maximum extent permitted by applicable law, PromptDek and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of or inability to use the Service.

Our total liability for any claim arising from these Terms or your use of the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $50 USD.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

We may suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise inappropriate. You may terminate your account at any time from your Account Settings page.

Upon termination, your right to access the Service ceases immediately. Purchased prompt licenses, unused credits, and subscription access are forfeited without refund in cases of termination for cause.

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in California, and you consent to personal jurisdiction in those courts.

We reserve the right to update these Terms at any time. When we do, we will update the effective date at the top of this page. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
